Terms of Service

Last updated May 6, 2026. By creating an account or paying for a course, you agree to these Terms.

Heads up: This is a starter Terms of Service written in plain English by the tubizy team. It reflects our actual practice today, but we recommend a qualified attorney review it for your jurisdiction before launch.

1. Acceptance of these terms

These Terms form a binding agreement between you and Mountain Harvest Media LTD ("tubizy", "we", "us"). By registering an account, paying for a course, attending a workshop, or otherwise using tubizy.ai, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Account registration

  • You must be at least 13 years old to register, and at least the age of legal adulthood in your jurisdiction to make purchases or join the reseller program.
  • One account per person. You are responsible for keeping your password confidential and for everything that happens under your account.
  • Provide accurate, complete information at sign-up and keep it up to date.
  • Tell us promptly at support@tubizy.ai if you suspect your account has been compromised.

3. Acceptable use

You agree not to:

  • Share your login or resell access without joining the reseller program.
  • Scrape, mirror, or systematically download course content, video, or AI responses.
  • Use the AI sandbox to generate content that violates law, infringes third-party rights, harasses or threatens others, contains hate speech, or attempts to produce malware, weapons instructions, or sexual content involving minors.
  • Probe, scan, or test the security of the platform, or attempt to bypass rate-limits or paywalls.
  • Reverse engineer, decompile, or copy the platform other than as expressly permitted by law.
  • Use the service in a manner that interferes with other students or imposes an unreasonable load on our infrastructure.

We may suspend or terminate accounts that violate this section, with or without notice depending on the severity.

4. Course access

  • When you purchase the AI-for-Business course, you receive lifetime access to the modules, downloads, and bonus content as long as the platform remains available.
  • If we discontinue the platform, we will give registered students at least 60 days’ notice and reasonable means to download their content and certificates.
  • Course content is licensed to you for your personal or single-business use. You may not republish, resell, or use the materials to train competing AI models without written permission.

5. In-person workshops

  • Workshop seats are tied to a specific date and location. You may reschedule once at no cost up to 7 days before your booked date, subject to availability.
  • If we cancel a workshop for any reason, you receive a full refund or a free reschedule, your choice.
  • If you no-show without rescheduling, the seat is forfeit (no refund).
  • Lunch and materials are included unless stated otherwise on the booking page.

6. AI usage and credits

  • Each course purchase includes $5 in AI credits for use in the in-platform AI sandbox.
  • Additional credits may be purchased; pricing is shown on the buy-credits page at the time of purchase.
  • Credits are consumed by token usage at the rate published in the sandbox. Heavy abuse-pattern usage may be throttled or rate-limited under fair-use rules.
  • Credits do not expire while your account is active. Credits are non-refundable once consumed; unused credits may be refunded under the refund policy below.
  • The AI provider may change pricing or model availability; we will pass through changes at cost.

7. Reseller program

  • Approved resellers earn a 20% commission on each qualifying course sale they refer; tubizy retains the remaining 80%.
  • Commissions are calculated on the net amount actually received by tubizy (after payment-processor fees and any refunds).
  • Commissions are paid monthly, on or about the 15th of the month following the sale, by PayPal to the email on file. Minimum payout: $25; balances below the minimum roll over.
  • Self-referrals do not earn commission. Refunded sales reverse any commission earned.
  • Resellers may not use deceptive marketing, paid search bidding on the "tubizy" trademark, or unsolicited bulk email. Violations may result in commission forfeiture and program termination.
  • Either party may terminate the reseller relationship at any time; pending earned commissions remain payable.

8. Refund policy

  • Self-paced course: 14-day money-back guarantee from the date of purchase. If you have used AI credits, the refund is prorated by the dollar value of credits consumed.
  • AI credit top-ups: refundable for unused credits within 30 days of purchase.
  • In-person workshop: full refund if requested at least 7 days before the event date; no refund within 7 days, but you may transfer your seat once.
  • Reseller sign-up fees: none currently charged.
  • Refunds return to the original payment method, typically within 5-10 business days.
  • Email support@tubizy.ai to request a refund.

9. Intellectual property

All course videos, slides, written lessons, downloads, beaver mascot, logos, and the underlying platform code are owned by Mountain Harvest Media LTD or our licensors and are protected by US and international copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the materials for the purpose for which they were sold.

10. Your content

You retain ownership of the prompts, notes, drafts, uploads, and other content you create on tubizy.ai ("Your Content"). By submitting Your Content to the platform, you grant us a worldwide, non-exclusive, royalty-free license to host, display, transmit, and process it solely as needed to provide the service to you. We do not use Your Content to train AI models. You are solely responsible for Your Content and represent that you have the rights necessary to submit it.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be inaccurate, incomplete, or unsuitable for your situation; you are responsible for reviewing them before relying on them. Nothing on tubizy.ai is legal, tax, financial, medical, or professional advice.

12. Limitation of liability

To the maximum extent permitted by law, Mountain Harvest Media LTD and its officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of or related to your use of the service. Our total cumulative liability for any claim arising out of these Terms is capped at the greater of (a) US $100, or (b) the total amount you actually paid to tubizy in the 12 months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion of certain damages; in those jurisdictions our liability is limited to the smallest amount permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Mountain Harvest Media LTD from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your use of the service in violation of these Terms, (b) Your Content, or (c) your violation of law or any third-party right.

14. Termination

You may delete your account at any time by emailing support@tubizy.ai from the address on file. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the service in a way that creates risk for tubizy or other users. Sections that by their nature should survive termination (IP, disclaimers, liability, governing law, refund-records retention) will survive.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be posted here, the "last updated" date will change, and registered users will receive at least 14 days’ email notice before the new terms take effect. Continued use after the effective date constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Colorado, and you consent to personal jurisdiction there. The parties will first attempt to resolve any dispute by good-faith negotiation, then by mediation, before initiating litigation. Nothing in this section limits a party’s right to seek emergency injunctive relief.
